Terms and Conditions of Use

Welcome to lumingon.

These Terms and Conditions ("Terms") govern your use of the lumingon platform, including our website (lumingon.com), mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our Services.

1. Introduction

lumingon operates an online real estate portal and property marketplace in the Republic of the Philippines. We provide software that connects property seekers with real estate brokers.

lumingon is a software and technology provider — not a real estate brokerage, agency, or property management company. We build and operate the platform; we do not create, verify, endorse, or guarantee any listing, and we are not a party to, and take no part in, any dealing, negotiation, or sale between users. Users and brokers are solely responsible for the accuracy, legality, and completeness of the listings they post and for any transaction they enter into.

2. User Accounts and Obligations

To access certain features, you may need to register for an account. By creating an account, you agree to:

3. Property Listings and Content Policies

Users (including real estate brokers) may publish property listings on lumingon. By posting content, you represent and warrant that:

Automated Moderation & Rejections: lumingon utilizes automated systems (including image and text analysis) to check listings for compliance with our content policies before they are published. Listings containing placeholder text, low-quality or violating images, or inaccurate data will be rejected automatically. Flagged listings can be edited and resubmitted by the user for a new compliance check.

AI-Assisted Listing Content: lumingon offers optional tools that draft or improve your listing copy, and that read a listing write-up you paste in so its fields can be pre-filled. Anything these tools produce is a draft for your review. You publish it, and you remain fully responsible for its accuracy and for every representation it makes about the property — exactly as if you had typed it yourself. You must not paste content you have no right to use, and you must not paste other people's personal information. Check AI-assisted copy before publishing; do not publish claims you cannot substantiate.

Usage Limits, Violations, and Lockouts: Automated review consumes resources, so submissions are subject to fair-use caps on the number of review attempts per account per day and per individual listing. Separately, if several of your listings are rejected within a short period, posting is automatically paused for a cooling-off window; the pause lifts by itself as those rejections age out, without you needing to contact us. These limits are guardrails against spam and abuse, not penalties: they pause posting and verification attempts only — you can still sign in, browse, and manage your existing listings. The current thresholds are published in our Help Center and may be adjusted to protect the marketplace. Serious or repeated abuse (such as attempting to post fake listings, spam, or inappropriate media, or attempting to evade these limits) may additionally result in suspension or permanent removal of the account.

Objectionable Content, Reporting, and Blocking: lumingon has zero tolerance for objectionable, abusive, fraudulent, or illegal content and conduct. You must not post or engage in content that is offensive, harassing, hateful, sexually explicit, discriminatory, deceptive, or that promotes a scam or an unlawful transaction. Any signed-in user can report a listing from the listing's menu (for reasons such as scam or fraud, misleading information, an already-sold property, or offensive content) and can block a broker or agent, which immediately hides that person and all of their listings from the person who blocked them. A listing that is reported enough times is automatically hidden from everyone pending review. We review reports and act on objectionable content — ordinarily within 24 hours — by removing the content and, where warranted, suspending or permanently removing the responsible user. lumingon reserves the right to review, edit, reject, or remove any listing or content that violates these Terms or is otherwise deemed inappropriate, without prior notice.

4. Verification, Public Registries, and What They Mean

PRC Verified Broker badge. A "PRC Verified Broker" badge indicates only that, at sign-up, the user completed an automated identity and liveness check and submitted a government-issued ID and PRC credential that were scanned and reviewed. It is a point-in-time signal — not an ongoing guarantee of a user's identity, current PRC licensure status, good standing, or good conduct — and it does not warrant the accuracy or legality of any listing or the legitimacy of any transaction.

Dealings outside lumingon are your responsibility. lumingon does not participate in, supervise, or control any dealing, viewing, negotiation, payment, or transaction that takes place off the platform. If you transact with a broker or any other user outside lumingon, you are solely responsible for your own due diligence — including physically inspecting the person's government ID, independently confirming their PRC license directly with the Professional Regulation Commission (PRC), verifying the property's title and documents, physically inspecting the actual unit, and confirming a project's DHSUD registration and License to Sell. These steps are outside lumingon's scope and control. Never send money or deposits without independently verifying the recipient and, where possible, meeting in person.

Board-Passer Directory (source: PRC). lumingon includes a searchable directory of licensure-examination passers (for example, the Real Estate Brokers Licensure Examination) compiled from results officially published by the Professional Regulation Commission (PRC). This directory is provided for general information only. An entry confirms that a name appeared in the officially published results of a past examination; it is not proof of a person's identity, current registration, license standing, or good conduct, and lumingon does not warrant the completeness or accuracy of the published results as reproduced. Always verify a professional's current license status directly with the PRC. If you are a listed board passer and wish to request a correction to, or removal of, your directory entry, contact us at dpo@lumingon.com.

License to Sell Directory (source: DHSUD). lumingon includes a searchable directory of projects with a License to Sell, compiled from the lists of projects officially published by the Department of Human Settlements and Urban Development (DHSUD). This directory is provided for general information only and reproduces publicly available data. An entry indicates that a project appeared on a published DHSUD list; it is not proof that a specific unit may lawfully be sold at any given time, and lumingon does not warrant the completeness, currency, or accuracy of the published lists as reproduced. Always confirm a project's current License to Sell and registration status directly with DHSUD before transacting.

Calculators, checklists, and other informational tools. lumingon provides informational tools — including loan/amortization calculators, tax estimators (such as capital gains, estate, and transfer tax), and due-diligence checklists. These tools produce general, simplified estimates based on the figures you enter and commonly applied rates; they do not account for your specific circumstances, current BIR or LGU rules, exemptions, deductions, penalties, or rate changes. They are provided for convenience only and do not constitute financial, tax, investment, or legal advice, and lumingon does not warrant their accuracy or applicability to any transaction. Always verify computations with the Bureau of Internal Revenue (BIR), the relevant local government unit, or a licensed professional before relying on them.

5. Limitation of Liability

The Services are provided on an "as is" and "as available" basis. lumingon makes no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the Services or the properties listed.

To the maximum extent permitted by Philippine law, lumingon and its affiliates, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of:

You agree to indemnify and hold harmless lumingon, its affiliates, and its employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

7. Intellectual Property and Your Content

All content, design, graphics, compilation, and other matters related to the Services are protected under applicable copyrights, trademarks, and other intellectual property laws. lumingon and its logo are trademarks of lumingon. You may not copy, redistribute, use, or publish any part of the Services without our express written permission.

Your content stays yours. You keep ownership of the listings, photos, and profile details you post. By posting them, you grant lumingon a non-exclusive, worldwide, royalty-free licence to host, store, resize, reproduce, and display that content for the purpose of operating and promoting the Services — including displaying it in the App, publishing it as a public page on lumingon.com, generating preview and shareable images of it, and allowing those public pages to be indexed by search engines and answer engines. You warrant that you hold the rights to everything you post, including the photographs.

Publication is public and can be cached elsewhere. Active listings and verified public profiles are published as pages on lumingon.com, not only inside the App. Once a page has been indexed or shared, copies may persist in third-party caches, search results, and AI assistants even after you remove the content from lumingon. You can unlist your profile from the directory and search, and you can delete a listing or your account at any time, and we will remove the corresponding pages from our sitemap and our own systems — but we cannot compel third parties to forget what they have already copied.

This licence ends when you delete the content or your account, except to the extent copies must be retained by law or already exist outside our systems as described above.

8. Modifications to the Terms

lumingon reserves the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Philippines.
