These Terms and Conditions ("Terms") govern your use of the lumingon platform, including our website (lumingon.com), mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our Services.

1. Introduction

lumingon operates as an online real estate portal and property marketplace in the Republic of the Philippines. We provide a platform that connects property seekers with property owners, real estate brokers, and agents.

lumingon is NOT a real estate brokerage, agency, or property management company. We do not represent buyers or sellers, nor do we participate in any lease or sale agreements between parties.

2. User Accounts and Obligations

To access certain features, you may need to register for an account. By creating an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and account credentials.
• Accept responsibility for all activities that occur under your account.
• Identity and Liveness Verification: To maintain trust, safety, and listing authenticity on our platform, you agree to undergo a mandatory automated liveness verification check (facial movement and blink analysis processed entirely on-device) before you are permitted to post property listings. Attempting to bypass, spoof, or manipulate this check is a violation of these Terms.

You must be at least 18 years old to create an account or use our Services.

3. Property Listings and Content Policies

Users (including real estate brokers, agents, and private owners) may publish property listings on lumingon. By posting content, you represent and warrant that:

• You have the legal right to advertise the property for sale or rent.
• The information provided is accurate, truthful, and not misleading.
• You comply with all applicable Philippine laws, including the Real Estate Service Act of the Philippines (RESA Law / R.A. No. 9646), and hold valid licenses if advertising as a professional broker or agent.
• Your listings do not contain spam, deceptive practices, placeholders (e.g., test listings, stock images, blank descriptions), or offensive material.

Automated Moderation & Rejections: lumingon utilizes automated AI systems (including image and text analysis models) to check listings for compliance with our content policies before they are published. Listings containing placeholder text, low-quality or violating images, or inaccurate data will be rejected automatically. Flagged listings can be edited and resubmitted by the owner for a new compliance check.

User Violations and Lockouts: In the event of repeated rejections or platform abuse (such as attempting to post fake listings, spam, or inappropriate media), our system will automatically enforce temporary or permanent account lockouts. Locked-out users will be blocked from logging in or creating new listings until the cooldown period expires or the account is reviewed.

lumingon reserves the right to review, edit, reject, or remove any listing or content that violates these Terms or is otherwise deemed inappropriate, without prior notice.

4. Limitation of Liability

The Services are provided on an "as is" and "as available" basis. lumingon makes no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the Services or the properties listed.

To the maximum extent permitted by Philippine law, lumingon and its affiliates, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of:

• Your use or inability to use the Services.
• Any interactions or transactions between you and other users (e.g., property disputes, fraudulent listings).
• Unauthorized access to or alteration of your data.

5. Indemnification

You agree to indemnify and hold harmless lumingon, its affiliates, and its employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

6. Intellectual Property

All content, design, graphics, compilation, and other matters related to the Services are protected under applicable copyrights, trademarks, and other intellectual property laws. lumingon and its logo are trademarks of lumingon. You may not copy, redistribute, use, or publish any part of the Services without our express written permission.

7. Modifications to the Terms

lumingon reserves the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Philippines.
